TERMS AND CONDITIONS OF USE 

These following paragraphs describe the terms & and conditions govern your use of the SingPost Mobile Application and/or the Services (as defined below).

1. TERMS OF USE

By downloading, browsing, accessing or using this SingPost mobile application (“Mobile Application”), you agree to be bound by these Terms and Conditions of Use. We reserve the right to amend these terms and conditions at any time. If you disagree with any of these Terms and Conditions of Use, you must immediately discontinue your access to the Mobile Application and your use of the Services offered on the Mobile Application. Continued use of the Mobile Application will constitute acceptance of these Terms and Conditions of Use, as may be amended from time to time. 

1.2 DEFINITIONS 

In these Terms and Conditions of Use, the following capitalised terms shall have the following meanings, except where the context otherwise requires: 

"SingPost", "we", "us" or "our" means Singapore Post Limited. 

“Affiliate” means Singapore Post Limited, any persons or entities that are controlled directly or indirectly by Singapore Post Limited, or are under common control with, or are controlled by, Singapore Post Limited. 

“Biometric Trait” means each biometric trait including but not limited to facial image, fingerprints and iris patterns enrolled by a Biometric Recognition Feature on the Registered Device. 

“Biometric Recognition Feature” means such biometric recognition feature of the Mobile Application including the face recognition feature of Apple’s iOS designated by Apple as “Face ID”. 

“Fingerprint” means each fingerprint enrolled by a Fingerprint Recognition Feature on the Registered Device. 

“Fingerprint Recognition Feature” means such fingerprint recognition feature of the Mobile Application including the fingerprint recognition feature of Apple’s iOS designated by Apple as “Touch ID”. 

“Mobile Application” means the software application called “SingPost Mobile Application” and any upgrades to it from time to time, provided by Singapore Post Limited to offer you the Services. 

“Registered Device” means the mobile device registered with us and enabled with the Fingerprint Recognition Feature and/or the Biometric Recognition Feature (where applicable). 

“Security Credentials” means the account, email address, unique identifier, business registration number, user identification code (such as User ID), Fingerprint, Biometric Trait and/or passwords and any other devices or information that may be issued by or which may be accepted by us from time to time for use by the User for the purposes of authenticating the User’s access and/or use of the Mobile Application and/or the Services. 

"Services" means all the services (including any pilot trial) provided by Singapore Post Limited via the Mobile Application to Users, and “Service” means any one of them. 

“Users” means users of the Mobile Application, including you.

2. LICENSE TO USE MOBILE APPLICATION

2.1 You will need to register for an account with us in order to utilise the Mobile Application and the Services, access any information related to your instructions given via the Mobile Application, access your account information and any other records associated with your use of the Mobile Application. 

2.1 You agree that you are solely responsible for maintaining the confidentiality of the Security Credentials, and may not claim against us for any loss or damage resulting from your failure to do so. 

2.2 To access the User’s account using a Fingerprint or Biometric Trait, the User must register the User’s mobile device in accordance with instructions, procedures and directions set out in the Mobile Application. Once the mobile device has been registered with us (such mobile device therefore now a Registered Device), information about the User’s account, as well as the Services, may be accessed using any Fingerprint or Biometric Trait enrolled by the relevant Fingerprint Recognition Feature and/or Biometric Recognition Feature on such Registered Device. We owe no duty to verify that each Fingerprint or Biometric Trait is the fingerprint or Biometric Trait, of the User. 

2.3 The User shall not enrol any Fingerprint or Biometric Trait of an unauthorised third party or permit any unauthorised third parties to enrol their Fingerprints or Biometric Traits on the Registered Devices. If the User has Fingerprint(s) or Biometric Trait(s) of such third parties registered on the Registered Device, such third parties may be able to access the User’s account and/or the Services as well. 

2.4 The User agrees and acknowledges that if the User uses a Fingerprint or Biometric Trait to access the account and/or the Services, the Mobile Application may be able to access the Fingerprint(s) or Biometric Trait(s) stored and registered on the Registered Device and the User hereby consents to us accessing and using such information for the purposes as described in these Terms and Conditions of Use herein. 

2.5 The User shall be responsible for all actions taken with reference to the Fingerprints and the Biometric Traits and shall keep fully secure and protect the Registered Device. The User agrees that the use of the Fingerprint and/or the Biometric Trait to access and/or use the App, Services and/or Content is dependent on Fingerprint Recognition Feature(s) or Biometric Recognition Feature(s) which are proprietary to third parties, and that the use of such Fingerprint Recognition Feature(s) or Biometric Recognition Feature(s) shall be in accordance with the applicable terms and conditions of the third party provider of the relevant Fingerprint Recognition Feature or Biometric Recognition Feature. We do not warrant that the use of the Fingerprint Recognition Feature(s) or Biometric Recognition Feature(s) will meet all or any of the User’s requirements. In particular, we do not warrant that the use of the Fingerprint Recognition Feature(s) or Biometric Recognition Feature(s) will always be available, accessible, complete, uninterrupted, timely, secure or error free. 

2.6 All use and/or access of the Mobile Application and/or Services referable to any of the Security Credentials (whether such access or use is authorised by the User or not) shall be deemed to be the use and/or access of the Mobile Application and/or Services by the User. 

2.7 The User is able to transmit instructions through the Mobile Application and/or Services. All instructions referable to any of the Security Credentials shall be deemed to be instructions validly transmitted and issued by the User. Such instructions shall be deemed to be irrevocable and we are entitled to act upon such instructions without requiring further consent. We shall not be obliged to investigate or verify the authenticity, the authority or the identity of any persons effecting any instructions or the authenticity, accuracy and completeness of such instructions. Notwithstanding this, we shall be entitled, at its own discretion, to decline to act or refrain from acting promptly upon any instructions and to investigate or verify the authenticity, the authority or the identity of such persons effecting the instructions or the authenticity, accuracy and completeness of the instruction. We may, in its discretion, refuse to comply with any instruction if the instruction is ambiguous or conflicting, incomplete or inaccurate. 

2.8 You shall immediately notify SingPost if it comes to your knowledge that any of the Security Credentials and/or the Registered Device has been compromised (including any loss, theft, breach of security, or unauthorised disclosure or use) and/or there has been unauthorised use of their account, the Mobile Application and/or the Services. 

2.9 We shall not be liable or responsible for any damage, expense or loss of any kind suffered directly or indirectly by the User as a result of any loss, disclosure, theft and/or unauthorised use of your Security Credentials and/or Registered Device. 

3. INFORMATION REQUIRED

3.1 To indicate your interest in certain products or services offered by us or our partners via the Mobile Application, you may need to provide us with, amongst others, your name, salutation, contact number, email address, company name and/or company address (as the case may be). Our Privacy Policy (see https://www.singpost.com/privacy-policy) shall apply in respect of any such information provided by you. 

3.2 In addition to and without prejudice to any other consent which you provide to us from time to time, you hereby authorise and consent to SingPost, our Affiliates and partners to collect, use and disclose your personal data for the following purposes: 

(a) The purposes for which you are required to provide the information pursuant to Clause 3.1 are as follows:  

(i) Name and salutation – for identification and proper address by us, our Affiliates or any of our partners (as the case may be) offering the products and services, pilot trials conducted by us (including the trial of the PostPal) for which you have indicated an interest in. 

(ii) Contact number and email address - for us, our Affiliates or any of our partners (as the case may be) to contact you directly via phone or email in relation to the products or services, pilot trials conducted by us (including the trial of the PostPal) for which you have indicated an interest in.  

(iii) Company name and company address – for identification by us of Users who are representatives of corporate entities and who have indicated an interest in certain products or services offered by us or any of our partners (as the case may be) on behalf of such corporate entities, and for us to follow up with such Users accordingly. 

(b)To provide you with access to and use of the Mobile Application, Services and/or participation in our pilot trials (including the trial of the PostPal); 

(c)To process payments and all other matters in connection with the Mobile Application and/or Services; 

(d)To communicate with you (which may include seeking feedback and comments on our Services (including pilot trial services such the trial of the PostPal) and/or responding to and taking follow-up action on your feedback and comments); 

(eTo update our records and to maintain your account; 

(fTo verify your identity and authority; 

(gTo develop new services and products; 

(h) To carry out analytics, research, planning and statistical assessment; 

(iTo market the activities, events and Services of SingPost, our Affiliates or business partners; and 

(jTo respond to any request of any public authority and/or agency.

4. GENERAL ISSUES ABOUT THE MOBILE APPLICATION AND THE SERVICES

4.1 Applicability of terms and conditions: The use of any Services and/or the Mobile Application is subject to these Terms and Conditions of Use. 

4.2 Location: The Mobile Application and the Services are intended solely for use by Users who access the Mobile Application in Singapore. We make no representation that the Services (or any goods or services) are available or otherwise suitable for use outside of Singapore. Notwithstanding the above, if you access the Mobile Application or use the Services from locations outside Singapore, you do so on your own initiative and are responsible for the consequences and for compliance with all applicable laws. 

4.3 Prevention on use: We reserve the right to prevent you from using the Mobile Application and the Service (or any part of them). 

4.4 Equipment and Networks: The provision of the Services and the Mobile Application does not include the provision of a mobile telephone or handheld device or other necessary equipment to access the Mobile Application or the Services. To use the Mobile Application or Services, you will require Internet connectivity and appropriate telecommunication links. You acknowledge that the terms of agreement with your respective mobile network provider (“Mobile Provider”) will continue to apply when using the Mobile Application. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the Mobile Application or any such third party charges as may arise. You accept responsibility for any such charges that arise. 

4.5 Permission to use Mobile Application: If you are not the bill payer for the mobile telephone or handheld device being used to access the Mobile Application, you will be assumed to have received permission from the bill payer for using the Mobile Application. 

4.6 Other Businesses: In addition to these Terms and Conditions of Use, the access and/or use of specific aspects of the Mobile Application and/or Services may be subject to additional terms and conditions that we may prescribe (for example product or service specific terms).  Access and/or use of additional services of our Affiliates or other third parties may also be provided through the Mobile Application and/or Services under separate agreements with our Affiliates or such other third parties where necessary. Such agreements shall strictly be between the User and such of our Affiliates or other third parties. Under no circumstances shall it be construed that, in the case of the User’s access to and use of the additional services of our Affiliates or any third party, we are a party to any transaction, if any, between the User and such Affiliate or third party, or that we endorse, sponsor, certify or are involved in the provision of such additional services through the Mobile Application and/or Services. 

4.7 Payments: 

4.7.1 Payment may be effected through eNETS, debit/credit card, or any other payment method we and/or the third party service providers make available to you. You agree that you are subject to the applicable user agreement of your payment method. 

 

4.7.2 We reserve the right at any time to modify or discontinue, temporarily or permanently, any payment method without notice to you or giving any reason.

 

4.7.3. You may not claim against us for any failure, disruption or error in connection with making payment through the Mobile Application or your chosen payment method. 

4.7.4 You are responsible for the information that you provide and the transaction(s) that you make, and you hereby declare that the information, instructions and/or communications that you have provided to SingPost are accurate, true and complete. If you are providing personal data of an individual other than yourself to us for the transaction(s) that you make, you hereby declare and affirm that you have notified and obtained consent from the individual to disclose his/her personal data to SingPost for the purposes of the transaction(s) and you can validly give consent for the collection, use and disclosure of personal data on behalf of the individual. 

4.7.5 Where you use a debit/credit card to effect payment through the Mobile Application, you acknowledge, agree and consent that his/her personal data may be disclosed to third parties (located within and outside of Singapore) processing such debit/credit card transactions, including debit/credit card companies, banks and payment gateways, and, subject to their respective personal data privacy policies and applicable laws, may be used, processed and stored by such third parties to facilitate payments made by you. 

4.7.6 We are under no obligation to verify the accuracy, authenticity and/or completeness of any information, instructions and/or communications received from you. We shall not be liable in any manner (including for direct or indirect losses) for any error, negligence, failure to check, act or omission on your part. Pursuant to SingPost's successful receipt of your payment, SingPost will effect or process the transaction(s) (that you have completed payment for) without any further consent from or reference or notice to you. 

4.7.7 We may, in our sole discretion, delay the execution of your request to carry out a payment transaction if there is reason to believe that your request to execute a transaction may involve fraud or misconduct, and/or violates any of these Terms and Conditions of Use and/or applicable law. 

4.7.8 You agree to treat as conclusive evidence, and not to dispute the validity, accuracy or authenticity of, any evidence or records maintained by SingPost (or any person authorised by SingPost) of your instructions and communications transmitted between yourself and SingPost through the Mobile Application and/or Services. This includes such evidence in the form of SingPost’s computer records, transaction logs, computer printouts, copies of any communication or any written statement by SingPost’s personnel.

5. YOUR OBLIGATIONS

5.1 Prohibitions in relation to usage of Services or Mobile Application: Without limitation, you undertake not to use or permit anyone else to use the Services or Mobile Application:- 

5.1.1 to send or receive any material which is not civil or tasteful; 

5.1.2 to send or receive any material which is threatening, grossly offensive, of an indecent, obscene or menacing character, blasphemous or defamatory of any person, in contempt of court or in breach of confidence, copyright, rights of personality, publicity or privacy or any other third party rights; 

5.1.3 to send or receive any material for which you have not obtained all necessary licences and/or approvals (from us or third parties); or which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party in any country in the world; 

5.1.4 to send or receive any material which is technically harmful (including computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data); 

5.1.5 to send unsolicited mail messages, including the sending of "junk mail" or other advertising material to individuals who did not specifically request such material. You are explicitly prohibited from sending unsolicited bulk mail messages. This includes bulk mailing of commercial advertising, promotional, or informational announcements, and political or religious tracts. Such material may only be sent to those who have explicitly requested it. If a recipient asks to stop receiving email of this nature, you may not send that person any further email; 

5.1.6 to create or forward "chain letters" or other "pyramid schemes" of any type, whether or not the recipient wishes to receive such mailings messages; 

5.1.7 to send malicious electronic communications email, including flooding a user or site with very large or numerous electronic communications emails; 

5.1.8 to cause annoyance, inconvenience or needless anxiety; 

5.1.9 to intercept or attempt to intercept any communications transmitted by way of a telecommunications system; 

5.1.10 for a purpose other than which we have designed them or intended them to be used; 

5.1.11 for any fraudulent purpose; 

5.1.12 other than in conformance with accepted Internet practices and practices of any connected networks; 

5.1.13 in any way which is calculated to incite hatred against any ethnic, religious or any other minority or is otherwise calculated to adversely affect any individual, group or entity; or 

5.1.14 in such a way as to, or commit any act that would or does, impose an unreasonable or disproportionately large load on our infrastructure. 

5.2 Prohibitions in relation to usage of Services and Mobile Application: Without limitation, you further undertake not to or permit anyone else to:- 

5.2.1 attempt to circumvent our security or network including to access data not intended for you, log into a server or account you are not expressly authorised to access, or probe the security of other networks (such as running a port scan); 

5.2.2 execute any form of network monitoring which will intercept data not intended for you; 

5.2.3 enter into fraudulent interactions or transactions with us, an Affiliate and/or a third party service provider Merchant (including interacting or transacting purportedly on behalf of a third party where you have no authority to bind that third party or you are pretending to be a third party); 

5.2.4 extract data from or hack into the Mobile Application; 

5.2.5 use the Services or Mobile Application in breach of these Terms and Conditions of Use; 

5.2.6 engage in any unlawful activity in connection with the use of the Mobile Application or the Services; or 

5.2.7 engage in any conduct which, in our exclusive reasonable opinion, restricts or inhibits any other customer from properly using or enjoying the Mobile Application or Services.

6. RULES ABOUT USE OF THE SERVICES AND THE MOBILE APPLICATION

6.1 We will use reasonable endeavours to correct any errors or omissions as soon as practicable after being notified of them. However, we do not guarantee that the Services or the Mobile Application will be free of faults and we do not accept liability for any such faults, errors or omissions. In the event of any such error, fault or omission, you should report it by contacting us at 1605. 

6.2 We do not warrant that your use of the Services or the Mobile Application will be uninterrupted and we do not warrant that any information (or messages) transmitted via the Services or the Mobile Application will be transmitted accurately, reliably, in a timely manner or at all. Notwithstanding that we will try to allow uninterrupted access to the Services and the Mobile Application, access to the Services and the Mobile Application may be suspended, restricted or terminated at any time. 

6.3 We do not give any warranty that the Services and the Mobile Application are free from viruses, malicious code or anything else which may have a harmful effect on any technology (including but not limited to software, hardware or data). 

6.4 We reserve the right to change, modify, substitute, suspend or remove without notice any information or Services on the Mobile Application from time to time. Your access to the Mobile Application and/or the Services may also be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore such access as soon as we reasonably can. For the avoidance of doubt, we reserve the right to withdraw any information or Services from the Mobile Application at any time. 

6.5 We reserve the right to block access to and/or to edit or remove any material which in our reasonable opinion may give rise to a breach of these Terms and Conditions of Use.

7. SUSPENSION AND TERMINATION

7.1 If you use (or anyone other than you, with your permission uses) the Mobile Application or any Services in contravention of these Terms and Conditions of Use, we may suspend your use of the Services and/or Mobile Application. 

7.2 If we suspend the Services or Mobile Application, we may refuse to restore the Services or Mobile Application for your use until we receive an assurance from you, in a form we deem acceptable, that there will be no further breach of the provisions of these Terms and Conditions of Use. 

7.3 Singapore Post Limited shall fully co-operate with any law enforcement authorities or court order requesting or directing Singapore Post Limited to disclose the identity or locate anyone in breach of these Terms and Conditions of Use. 

7.4 Without limitation to anything else in this Clause 7, we shall be entitled immediately or at any time (in whole or in part) to: (a) suspend the Services and/or Mobile Application; (b) suspend your use of the Services and/or Mobile Application; and/or (c) suspend the use of the Services and/or Mobile Application for persons we believe to be connected (in whatever manner) to you, if: 

7.4.1 you commit any breach of these Terms and Conditions of Use; 

7.4.2 we suspect, on reasonable grounds, that you have, might or will commit a breach of these Terms and Conditions of Use; or 

7.4.3 we suspect, on reasonable grounds, that you may have committed or be committing any fraud against us or any person. 

7.5 Our rights under this Clause 7 shall not prejudice any other right or remedy we may have in respect of any breach or any rights, obligations or liabilities accrued prior to termination.

8. DISCLAIMER AND EXCLUSION OF LIABILITY

8.1 The Mobile Application, the Services, the information on the Mobile Application and use of all related facilities are provided on an "as is, as available" basis without any warranties whether express or implied. 

8.2 To the fullest extent permitted by applicable law, we disclaim all representations and warranties relating to the Mobile Application and its contents, including in relation to any inaccuracies or omissions in the Mobile Application, warranties of merchantability, quality, fitness for a particular purpose, accuracy, availability, non-infringement or implied warranties from course of dealing or usage of trade. 

8.3 We do not warrant that the Mobile Application will always be accessible, uninterrupted, timely, secure, error free or free from computer virus or other invasive or damaging code or that the Mobile Application will not be affected by any acts of God or other force majeure events, including inability to obtain or shortage of necessary materials, equipment facilities, power or telecommunications, lack of telecommunications equipment or facilities and failure of information technology or telecommunications equipment or facilities. 

8.4 While we may use reasonable efforts to include accurate and up-to-date information on the Mobile Application, we make no warranties or representations as to its accuracy, timeliness or completeness. 

8.5 WE SHALL NOT BE LIABLE FOR ANY ACTS OR OMISSIONS OF ANY THIRD PARTIES HOWSOEVER CAUSED, AND FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, HOWSOEVER CAUSED, RESULTING FROM OR IN CONNECTION WITH THE MOBILE APPLICATION AND THE SERVICES OFFERED IN THE MOBILE APPLICATION, YOUR ACCESS TO, USE OF OR INABILITY TO USE THE MOBILE APPLICATION OR THE SERVICES OFFERED IN THE MOBILE APPLICATION, RELIANCE ON OR DOWNLOADING FROM THE MOBILE APPLICATION AND/OR SERVICES, OR ANY DELAYS, INACCURACIES IN THE INFORMATION OR IN ITS TRANSMISSION INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF BUSINESS OR PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

8.6 We shall not be liable in contract, tort (including negligence or breach of statutory duty) or otherwise howsoever and whatever the cause thereof, for any indirect, consequential, collateral, special or incidental loss or damage suffered or incurred by you in connection with the Mobile Application and these Terms and Conditions of Use. For the purposes of these Terms and Conditions of Use, indirect or consequential loss or damage includes, without limitation, loss of revenue, profits, anticipated savings or business, loss of data or goodwill, loss of use or value of any equipment including software, claims of third parties, and all associated and incidental costs and expenses. 

8.7 The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer that cannot be excluded or limited are affected. Notwithstanding our efforts to ensure that our system is secure, you acknowledge that all electronic data transfers are potentially susceptible to interception by others. We cannot, and do not, warrant that data transfers pursuant to the Mobile Application, or electronic mail transmitted to and from us, will not be monitored or read by others. 

8.8 For your convenience, the Mobile Application may include, refer to or make available hyperlinks to other third-party websites or content (including that of the third party service providers and payment method providers). Such linked websites or content are not under our control and we are not responsible for examining or evaluating, and do not warrant the offerings of, any of these businesses or individuals or the content of their websites or services. Any hyperlinks to any other websites or content are not an endorsement or verification of such websites or content. You agree that you use and/or access such linked websites or content entirely at your own risk and you should carefully review their privacy statements and other terms and conditions of use.  We are not responsible for the contents of or the consequences of accessing any such linked website, nor for any goods or services provided through any such linked websites.

 

8.9. Anti-money laundering: We are required to comply with laws in Singapore which relate to the prevention of money laundering, terrorist financing and the provision of financial and other services to any persons or entities which may be subject to sanctions. We may take any action which it considers necessary or appropriate to take to comply with such laws. SingPost will not be liable for any loss or damage suffered by any party arising out of any delay or failure of SingPost in the performance of this Agreement or other obligations caused in whole or in part by any steps which SingPost considers appropriate to take in accordance with this Clause.

9. INDEMNITY

You agree to indemnify and keep us indemnified against any claim, action, suit or proceeding brought or threatened to be brought against us which is caused by or arising out of (a) your use of the Services and/or (b) your breach of any of these Terms and Conditions of Use, and to pay us damages, costs and interest in connection with such claim, action, suit or proceeding. 

10. INTELLECTUAL PROPERTY RIGHTS

10.1 All editorial content, information, photographs, illustrations, artwork and other graphic materials, and names, logos and trade marks on the Mobile Application are protected by copyright laws and/or other laws and/or international treaties, and belong to us, our Affiliates and/or our third party service providers suppliers, as the case may be. These works, logos, graphics, sounds or images may not be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted or circulated whether in whole or in part, unless expressly permitted by us, our Affiliates and/or our third party service providers suppliers, as the case may be. 

10.2 Nothing contained on the Mobile Application should be construed as granting by implication, estoppel, or otherwise, any license or right to use any trademark displayed on the Mobile Application without our written permission. Misuse of any trademarks or any other content displayed on the Mobile Application is prohibited. We will not hesitate to take legal action against any unauthorised usage of our trade marks, name or symbols to preserve and protect its rights in the matter. All rights not expressly granted herein are reserved. Other product and company names mentioned herein may also be the trade marks of their respective owners.

11. AMENDMENTS

11.1 We may periodically make changes to the contents of the Mobile Application, including to the descriptions and prices of goods and services advertised, at any time and without notice. We assume no liability or responsibility for any errors or omissions in the content of the Mobile Application. 

11.2 We reserve the right to amend these Terms and Conditions of Use from time to time without notice. The revised Terms and Conditions of Use will be posted on the Mobile Application and shall take effect from the date of such posting. You are advised to review these terms and conditions periodically as they are binding upon you.

12. APPLICABLE LAW AND JURISDICTION

12.1 The Mobile Application can be accessed from all countries around the world where the local technology permits. As each of these places have differing laws, by accessing the Mobile Application both you and we agree that the laws of the Republic of Singapore, without regard to the conflicts of laws principles thereof, will apply to all matters relating to the use of the Mobile Application. You accept and agree that both you and we shall submit to the exclusive jurisdiction of the courts of the Republic of Singapore in respect of any dispute arising out of and/or in connection with these Terms and Conditions of Use.

13. PRIVACY POLICY

13.1 We will comply with the Personal Data Protection Act 2012 of Singapore (“PDPA”) on protecting personal data (as defined in the PDPA) that we receive in connection with the use of the Mobile Application and/or the Services. Access to the Mobile Application and use of the Services offered on the Mobile Application by Singapore Post Limited and/or its group of companies is subject to our Privacy Policy at https://www.singpost.com/privacy-policy which may be updated and/or amended from time to time, which shall be deemed to be incorporated into these Terms and Conditions of Use. By accessing the Mobile Application and by continuing to use the Services offered, you are deemed to have accepted our Privacy Policy, and in particular, you are deemed to have consented to our collection, use and disclosure of your personal information in the manner prescribed in our Privacy Policy and for the purposes set out in our Privacy Policy and in Clause 3.2. We reserve the right to amend our Privacy Policy from time to time. If you disagree with any part of our Privacy Policy, you must immediately discontinue your access to the Mobile Application and your use of the Services. 

13.2 As part of the normal operation of our Services, we collect, use and, in some cases, disclose information about you to third parties. Accordingly, we have developed our Privacy Policy in order for you to understand how we collect, use, communicate and disclose and make use of your personal information when you use the Services on the Mobile Application:-  

(a) Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.  

(b) We will collect and use of personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.  

(c) We will only retain personal information as long as necessary for the fulfillment of those purposes.  

(d) We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.  

(e) Personal information should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.  

(f) We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained.
